1. Introduction and Scope

Apex Tutoring ("Apex Tutoring," "we," "us," or "our") is a division of LonageWorks LLC, operating under the website apextutoring.net. We provide premium, personalized tutoring services—primarily in STEM disciplines—to students in grades 6 through 12 and beyond. We are committed to protecting the privacy and security of the students and families we serve.

This Privacy Policy describes how we collect, use, disclose, and safeguard personal information—including information about minors—in connection with our tutoring services, our website, and our client portal. It applies to all information collected through our website, enrollment forms, client accounts, tutoring sessions, and any other interactions you have with Apex Tutoring.

This policy is designed to comply with: the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA); the Children's Online Privacy Protection Act (COPPA); the Family Educational Rights and Privacy Act (FERPA), to the extent applicable; and all other applicable California and federal privacy laws.

By enrolling a student in Apex Tutoring or using our website or client portal, you acknowledge that you have read and agree to this Privacy Policy.

2. Information We Collect

2.1 Student Information

• Full legal name
• Home address
• Academic history (grades, transcripts, course history)
• Current school records (enrollment status, current courses, teacher information where provided)
• Standardized test scores (SAT, ACT, AP, PSAT, or other assessments)
• Learning goals, educational needs, and any learning accommodations or IEP/504 information voluntarily provided
• Student learning profile (a structured written assessment of learning modalities, strengths, and areas for growth, developed during the intake process)
• Session notes recorded by tutors following each tutoring session
• Formative assessment results and practice test scores generated during instruction

2.2 Parent or Guardian Information

• Full name(s) of parent(s) or legal guardian(s)
• Contact information (phone, email, home address)
• Billing and payment information (processed securely through our payment processor, Stripe)
• Emergency contact information
• Session feedback submitted through our post-session parent surveys

2.3 Session Recordings

For online tutoring sessions conducted via video conferencing platforms (such as Zoom or Google Meet), session recordings may be created with your written consent. Recordings are used solely for quality assurance, tutor coaching, and to allow parents to review session content through the client portal. Recordings are not shared with any third party except as required by law. You may withdraw consent for future recordings at any time by contacting us. Withdrawal of consent does not affect the validity of recordings already made.

2.4 Client Portal Account Data

Parents are provided with an individual client portal account through which they may access student assessments, session notes, learning plans, session recordings (if applicable), and invoices. Account login credentials and access activity associated with your portal account are stored as part of your account record.

2.5 Information Collected Automatically

• Website usage data (pages visited, time on site, browser type)
• IP address
• Cookie data (see Section 9)

2.6 Information We Do Not Collect

We do not collect Social Security numbers, government-issued identification numbers, or financial account information directly. Payment processing is handled by Stripe; we do not store card numbers or bank account details on our systems.

3. How We Use Student and Family Information

We use the information we collect only for the following purposes:

• To enroll students and provide tutoring services tailored to their academic needs
• To conduct intake assessments and develop personalized student learning profiles and written learning plans
• To communicate with parents and guardians about student progress, scheduling, session notes, and billing
• To provide parents with access to student records, session notes, assessments, and recordings through the client portal
• To assign the most appropriate employee tutor based on the student's learning profile and subject needs
• To request or obtain academic records from schools or institutions, with parent/guardian authorization
• To administer and analyze post-session parent satisfaction surveys for quality assurance purposes
• To process payments for services rendered
• To conduct quality assurance, including review of session recordings, tutor performance monitoring, and client feedback analysis
• To comply with legal obligations, including mandatory reporting requirements under California law
• To contact you about service updates, policy changes, or important notices
• To improve our services, curriculum offerings, and instructional methodology

We do not use student information for marketing purposes. We do not sell student data to any third party at any time, under any circumstances.

4. Disclosure of Information to Third Parties

We share personal information only in the following limited circumstances:

4.1 Academic Record Retrieval

With written authorization from a parent or legal guardian, we may share a student's name and identifying information with their current or former school, school district, testing organization (such as College Board or ACT, Inc.), or other educational institution solely for the purpose of obtaining academic records. We do not share this information for any other purpose.

4.2 Payment Processing

Billing-related information (parent/guardian name and payment details) is shared with Stripe, our third-party payment processor, to facilitate tuition and fee collection. Stripe is contractually required to protect your information and is prohibited from using it for any other purpose. Stripe's privacy practices are governed by its own privacy policy, available at stripe.com/privacy.

4.3 Tutoring Management Platform

We use a third-party tutoring management platform (currently TutorBird or TutorCruncher) to manage scheduling, session records, session notes, client communications, invoicing, and parent portal access. Student and family information is stored within this platform as necessary to deliver services. We will only use platforms that maintain appropriate privacy and security protections for student data, and we will identify our current platform upon request.

4.4 AI-Assisted Educational Tools

We may use third-party AI-powered educational tools to support instruction, generate practice materials, and assist in developing personalized learning content. Tools that may process student-related information in connection with instructional support include:

• Khan Academy (Khanmigo) — AI tutoring assistant for between-session practice
• Formative.com — AI-assisted formative assessments
• Quizlet AI — personalized flashcard and quiz generation
• IXL Learning — adaptive STEM practice platform
• Wolfram Alpha — calculation and problem verification

Where student information is submitted to these tools, we use only the minimum information necessary and do not submit personally identifiable information (such as full name or address) to AI tools unless the platform specifically requires it and maintains appropriate student data protections. We will update this list as our tool set evolves and will provide notice of material changes per Section 11.

4.5 Employee Tutors

Student learning profiles, session notes, learning plans, and other educational records are shared with the assigned employee tutor(s) to the extent necessary to provide effective instruction. All tutors are W-2 employees of LonageWorks LLC and are subject to confidentiality obligations and our Tutor Code of Conduct, which prohibits unauthorized disclosure or use of student information.

4.6 Legal Compliance and Mandatory Reporting

We are required by California law to report suspected child abuse or neglect to the appropriate authorities. As a provider of educational services to minors, our staff are mandated reporters under California Penal Code Section 11165 et seq. We may also disclose information in response to a lawful court order, subpoena, or legal process.

4.7 Emergency Situations

In the event of a medical emergency or situation involving the immediate safety of a student, we may share necessary information with emergency responders, medical personnel, or law enforcement.

4.8 Business Succession

In the unlikely event that Apex Tutoring or LonageWorks LLC is sold, merged, or transferred to a successor entity, student and family information may be transferred as part of that transaction. We will notify affected families prior to any such transfer and ensure that the successor entity agrees to honor this Privacy Policy or provide comparable protections.

4.9 No Other Sharing

We do not share, sell, rent, or trade student or family information with any third party for marketing, advertising, or commercial purposes. Names, academic records, learning profiles, session recordings, and personal information are never disclosed except as described in this Section 4.

5. Children's Privacy (COPPA Compliance)

Apex Tutoring primarily serves minors under the age of 18. We take special care to protect the privacy of children under the age of 13 in accordance with the Children's Online Privacy Protection Act (COPPA).

• We do not knowingly collect personal information directly from children under 13 through our website without verifiable parental consent.
• All enrollment and intake information for students under 13 is collected from and through a parent or legal guardian.
• Client portal accounts are provided to parents or guardians, not to students under 13.
• Parents and guardians may review their child's information, request corrections, or request deletion of their child's information at any time (subject to legal retention requirements).
• We do not use student information collected from minors for behavioral advertising or profiling.
• Session recordings involving students under 13 are only created with explicit written parental consent and are accessible only to the parent/guardian through the client portal and to authorized Apex Tutoring staff for quality assurance purposes.

If you believe we have inadvertently collected personal information from a child under 13 without parental consent, please contact us immediately at the address listed in Section 10 and we will delete that information promptly.

6. California Privacy Rights (CCPA/CPRA)

6.1 Right to Know

You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you or your child, the categories of sources from which that information was collected, the business purpose for collecting it, and the categories of third parties with whom we share it.

6.2 Right to Delete

You have the right to request deletion of personal information we have collected from you or your child, subject to certain exceptions (such as information we are required to retain by law or that is necessary to complete an active enrollment or service agreement).

6.3 Right to Correct

You have the right to request correction of inaccurate personal information we maintain about you or your child.

6.4 Right to Opt Out of Sale or Sharing

We do not sell or share personal information for cross-context behavioral advertising. No opt-out is required because we do not engage in these activities.

6.5 Right to Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights. Exercising your rights will not result in denial of services, lower quality of service, or different pricing.

6.6 How to Submit a Request

To exercise any of the rights described above, please contact us at: privacy@apextutoring.net. We will respond to verifiable requests within 45 days as required by California law.

7. Data Retention

• Active student records, learning profiles, session notes, and portal data are retained for the duration of enrollment and service provision.
• Session recordings are retained for 12 months following the date of recording, after which they are securely deleted unless subject to a legal hold.
• Following the conclusion of services, academic and educational records are retained for a minimum of three (3) years to comply with California business record requirements.
• Financial and payment records are retained for seven (7) years in accordance with California tax and accounting requirements.
• Records subject to a legal hold, litigation, or regulatory requirement will be retained for the duration of that requirement.

Upon the expiration of applicable retention periods, we will securely destroy or anonymize personal information.

8. Data Security

We implement reasonable and appropriate technical, administrative, and physical safeguards to protect the personal information we collect from unauthorized access, disclosure, alteration, or destruction. These measures include:

• Secure, password-protected client portal with individual parent/guardian login credentials
• Secure storage of digital records with access controls limited to authorized staff and assigned tutors
• Encrypted transmission of data via our website and client portal (SSL/TLS)
• Restricted access to physical files containing student information
• Staff and tutor training on privacy obligations and data handling procedures
• All business communications between tutors, students, and parents conducted through our approved business platform; direct personal communications between tutors and students are prohibited

No method of data transmission or storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach that affects your personal information, we will notify you as required by California law (Civil Code Section 1798.82).

9. Website Cookies and Tracking

Our website (apextutoring.net) may use cookies and similar tracking technologies to improve website functionality and user experience. We do not use cookies to track or profile students for advertising purposes.

You may disable cookies through your browser settings. Disabling cookies may affect certain website functionality but will not affect your ability to enroll in or receive tutoring services.

11. Updates to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, services, or the third-party tools we use. When we do, we will post the updated policy on our website with a revised effective date. For material changes affecting how we use or share student information—including changes to the list of AI-assisted educational tools in Section 4.4—we will provide notice to enrolled families by email or written communication at least 30 days before the change takes effect.

Your continued use of our services following notice of any changes constitutes acceptance of the updated policy.

12. Our Commitment

Apex Tutoring operates in accordance with the LonageWorks Code of Ethics. We are committed to honesty and transparency in all of our business practices. We will never give false information about how we use your data. We treat the safety and well-being of every student as our highest priority—including the protection of their personal information and the security of their academic records, learning profiles, and session recordings. We will never exploit student data for commercial gain.
