These Terms of Service ("Terms") govern your use of the Apex Tutoring website (apextutoring.net), client portal, and tutoring services (collectively, the "Services"), provided by LonageWorks LLC d/b/a Apex Tutoring ("Apex Tutoring," "we," "us," or "our"). By visiting our website, enrolling a student, or otherwise using our Services, you ("you," "parent," or "guardian") agree to be bound by these Terms. If you do not agree, please do not use our Services.
Because our Services are provided to minors, all enrollment is completed by a parent or legal guardian, who is the contracting party under these Terms regardless of the student's age.
Apex Tutoring provides private tutoring, small group tutoring, and multi-year academic planning services (including the Apex Pathway program) in STEM subjects, language arts, world languages, and standardized test preparation, delivered in-home or remotely by Apex Tutoring employee tutors. Specific services, subjects, session frequency, and pricing for your student are set out in your individual Client Service Agreement, which supplements and is incorporated into these Terms.
Online sessions may be recorded for quality assurance and parent review purposes, but only with your written consent as described in our Privacy Policy. You may withdraw consent for future recordings at any time by contacting us.
We ask that students and parents treat tutors with the same respect and professionalism we expect our tutors to bring to every session. Apex Tutoring maintains a Tutor Code of Conduct governing tutor behavior, including a strict prohibition on any conduct of a romantic or sexual nature toward a student, unauthorized personal contact with students outside approved communication channels, and a two-adult/open-door policy for in-home sessions. We expect families to support these policies, including by not requesting that a tutor depart from them.
Apex Tutoring is committed to providing structured, high-quality instruction, and we take the design of every Learning Plan seriously. However, we do not and cannot guarantee any specific outcome, including a particular grade, test score, or admission to any college or university. Academic outcomes depend on many factors beyond our control, including the student's own effort, school-based instruction, and factors specific to each college's admissions process. Any statements about the value or approach of our program should not be understood as a promise of a particular result.
Learning Plans, Academic Roadmaps, session notes, curriculum materials, and other instructional content developed by Apex Tutoring remain the intellectual property of LonageWorks LLC. Families receive a personal, non-transferable license to use these materials for their own student's education. These materials may not be resold, redistributed, or used to provide tutoring services to other students without our written consent.
You agree not to use the Apex Tutoring website in any way that violates applicable law, attempts to gain unauthorized access to our systems, or interferes with the proper functioning of the website or client portal.
To the fullest extent permitted by California law, Apex Tutoring's total liability arising out of or related to the Services is limited to the amount you paid for the specific services giving rise to the claim in the preceding three months. Apex Tutoring is not liable for indirect, incidental, or consequential damages, including lost educational opportunity, arising from the use of our Services. Nothing in these Terms limits liability that cannot be limited under California law, including liability for gross negligence, willful misconduct, or harm to a minor arising from Apex Tutoring's own conduct.
Either party may end the tutoring relationship at any time, subject to the notice and financial terms described in your Client Service Agreement. Apex Tutoring may terminate services immediately in the event of a violation of our Code of Conduct, safeguarding policies, or these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Services will first be addressed through good-faith direct discussion between the parties. If a dispute cannot be resolved informally, it will be subject to the jurisdiction of the state or federal courts located in Ventura County, California, unless otherwise specified in your Client Service Agreement.
We may update these Terms from time to time to reflect changes in our services or legal requirements. When we do, we will post the updated Terms on our website with a revised effective date. Material changes will be communicated to enrolled families in advance where practicable. Continued use of our Services after a change takes effect constitutes acceptance of the updated Terms.
